A fight is playing out inside the cannabis industry over the future of hemp-derived THC, and TDR Cannabis in 5 breaks down both sides. Host Shadd Dales starts with the Marijuana Policy Project's call for Congress to stop the scheduled federal ban and replace it with regulation, including potency limits, testing, labeling and age restrictions. Under the 2018 Farm Bill, hemp is legal below 0.3% delta-9 THC by dry weight, which created a market for intoxicating hemp products sold outside dispensaries. Legislation signed last year tightened the federal definition, and unless Congress acts, many of those products become illegal. Then the pushback. In a Marijuana Moment op-ed, Chris Lindsey, a former MPP staffer now with the American Trade Association for Cannabis and Hemp, argues that intoxicating hemp competes without the testing, tracking, taxes and licensing marijuana businesses must follow, and raises concerns about synthetic cannabinoids and social equity programs. Aaron Smith, co-founder of the National Cannabis Industry Association, responds that the same THC molecule shouldn't be treated differently based on its source, and favors consistent rules, with lower-dose products staying available outside dispensaries. The host adds his own view, shaped by a conversation with a hemp farmer: regulation only works if it closes the loopholes for synthetic conversions, and a proposed two-year bridge in the Goodness of Hemp Act draft worries him. The key dates are November 12 for certain synthetic cannabinoids and December 11 for most other products.Should hemp THC follow the same rules as marijuana, or different ones depending on where it's sold?
