On this episode of Conduct Detrimental: THE Sports Law Podcast, Dan Lust (@SportsLawLust) and Mike Kravchenko (Watch on YouTube) open with a quick look at what it means to call yourself a lawyer, prompted by the White House press secretary story, before getting into the week’s biggest sports law news.
First, the college sports landscape. The Protect College Sports Act has passed the Senate and heads to the House. Dan runs the House-settlement math on the NCAA’s Class of 2022 exposure, which could approach ten figures, and explains why he thinks the chaos is part of the NCAA’s strategy to win an antitrust exemption.
Then the wildcard: NCAA v. DeWine. Ohio’s governor ordered in-state schools to give the Class of 2022 a fifth year, and the NCAA sued him in federal court within about 48 hours. The guys walk through the Commerce Clause, First Amendment, and state-law claims, Charlie Baker’s “turn square corners” line, and why families may start picking schools based on which states have athlete-friendly governors and courts.
Breaking during the record: Josh Jacobs is reportedly coming off the Commissioner Exempt List and is expected to be eligible in Week 7. That comes a day after he filed a civil action seeking a permanent injunction to keep the video of the incident from ever being released.
In the back half: Pablo Torre’s investigation into LeBron James’ Fanatics helicopter deal. The key facts:
- a 2-year, $8M contract with the Sixers
- Michael Rubin’s former Sixers stake
- a helicopter tail number that changed to “N6FN”
- a Topps card that posted before Shams
Dan explains what would actually have to be true for it to be cap circumvention, and why star players taking less money to win is nothing new.
Finally, the NBA’s memo to partner sportsbooks pulling same-player under parlays, “first of” markets, and low-minute unders. The guys get into why it’s a contract fix rather than a legal one, what it says about the league’s trust in its players, and the gap it leaves open at prediction markets like Kalshi and Polymarket.
