Serving China Just Got Harder: The Hague Ruling Shaking Up Schedule A Cases

In this week's Legal Speak episode, Law.com reporter Alex Anteau and Chicago-Kent College of Law professor Sarah Fackrell examine a recent federal appeals court decision that could reshape how intellectual property lawsuits are served on defendants in China. The U.S. Court of Appeals for the Seventh Circuit joined the Second Circuit in holding that service by email is not permitted under the Hague Service Convention. The May 29, 2026 ruling is expected to have significant implications for the high-volume Schedule A trademark and copyright infringement cases frequently filed in the U.S. District Court for the Northern District of Illinois.
