Lesson 55 – ʿUmdat al-Fiqh – Book of Transactions 3 – Ustādh Abdul Hakeem Mitchell – Selling Land, Trees and Fruits

Dela

ʿUmdat al-Fiqh by Ibn Qudāmah al-Maqdisī (raḥimahullāh), with the explanation of Shaykh ʿAbdullāh al-Bassām and Shaykh ʿUbayd al-Jābirī (raḥimahumallāh), taught by Ustādh Abdul Hakeem Mitchell (hafidhahullāh)

• Recap of ribā: the six commodities, those measured by value (gold and silver) and those measured by weight • When trading the same commodity it must be equal and hand to hand, and when trading within the same group it must be hand to hand • Disguised ribā through an item placed in between, and why agreeing to a ribā contract is itself ḥarām • Selling land and trees: what goes with the asset and what stays with the seller • The fruits that have appeared belong to the seller, unless the buyer stipulates them, and only for that first season • A sale must not contain uncertainty (gharar), and the seller bears blight that strikes the fruits before they are handed over

Recorded at The Salafi Centre of Manchester on 14/7/24
