After a man 30-year-old man named Jordan Neely began aggressively threatening passengers on a New York Subway, saying he was going to kill someone, Penny placed him in a chokehold.
Neely passed out and was later pronounced dead at the hospital where his death was ruled a homicide by compression of the neck. Neely had a long criminal record, including 42 arrests and three unprovoked assaults on women in the subway.
26-year-old Penny faces charges of second-degree manslaughter and criminally negligent homicide.
Penny faces up to 19 years in prison if convicted.
